2. Description of Service

CoverImage.app is an AI-powered image search service that helps users find cover images from third-party stock photo providers (Pexels, Pixabay). We provide:

AI-powered content analysis to suggest relevant images
Keyword-based image search across multiple providers
Links to download images from their original sources

IMPORTANT: CoverImage.app does NOT host, store, or own any images. All images are hosted by and remain the property of their respective providers (Pexels, Pixabay) and their original creators.

3. Image Licensing - YOUR RESPONSIBILITY

YOU ARE SOLELY RESPONSIBLE for determining and complying with all applicable licensing requirements for any images you use.

Images accessed through our Service are subject to the license terms of their respective sources (Pexels License, Pixabay License).
We do not grant any license to images. Any license comes directly from the image provider.
You must verify that your intended use complies with the applicable license before using any image.
Some images may require attribution, model releases, or property releases for certain uses. It is YOUR responsibility to determine these requirements.
Images may not be sold or distributed on a standalone basis without additional creative work.

4. AI Analysis Disclaimer

Our AI-powered content analysis is provided for convenience only:

AI analysis is provided "AS IS" without any warranty of accuracy, completeness, or reliability.
AI-generated suggestions may be inaccurate, incomplete, or inappropriate for your specific use case.
You should not rely solely on AI analysis for any professional, legal, or commercial decisions.
We are not responsible for any errors, omissions, or consequences resulting from AI analysis.
AI analysis is processed by third-party providers (OpenRouter) subject to their own terms.

5. User Responsibilities

You agree to:

Use the Service only for lawful purposes
Not submit content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
Not attempt to circumvent any usage limits or security measures
Not use the Service to infringe on any third-party rights
Not use automated scripts, bots, or scrapers except as expressly permitted
Comply with all applicable laws and regulations
Comply with the terms of service of all third-party providers (Pexels, Pixabay)

6. Subscription, Payments, and Refunds

For paid subscriptions:

Payments are processed securely through LemonSqueezy
Subscriptions renew automatically unless cancelled
Cancel anytime: You may cancel your subscription at any time through your account dashboard. Cancellation takes effect at the end of the current billing period, and you will retain access until then.
14-day money-back guarantee: If you are not satisfied with your paid subscription, you may request a full refund within 14 days of your initial purchase. To request a refund, contact us at support@coverimage.app. Refunds are processed within 5-10 business days.
Refund requests made after 14 days are evaluated on a case-by-case basis at our discretion
We reserve the right to change pricing with 30 days notice to existing subscribers
We may suspend or terminate accounts for non-payment or Terms violations

7. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

WARRANTIES OF MERCHANTABILITY
FITNESS FOR A PARTICULAR PURPOSE
NON-INFRINGEMENT
ACCURACY OR COMPLETENESS OF CONTENT
UNINTERRUPTED OR ERROR-FREE OPERATION
SECURITY OR FREEDOM FROM VIRUSES

We do not warrant that: (a) the Service will meet your requirements; (b) the Service will be uninterrupted, timely, secure, or error-free; (c) any results obtained from the Service will be accurate or reliable; (d) any images will be available or suitable for your purposes.

8. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COVERIMAGE.APP AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY:

INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES
DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE
DAMAGES ARISING FROM THIRD-PARTY CONTENT, IMAGES, OR SERVICES
DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO YOUR DATA
DAMAGES ARISING FROM AI ANALYSIS ERRORS OR INACCURACIES

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100 USD).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

9. Indemnification

You agree to indemnify, defend, and hold harmless CoverImage.app and its owners, officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

Your use of the Service
Your violation of these Terms
Your violation of any third-party rights, including intellectual property rights
Your use of any images obtained through the Service
Any content you submit to the Service
Your violation of any applicable laws or regulations

10. Third-Party Services

The Service integrates with third-party services including Pexels, Pixabay, OpenRouter, and LemonSqueezy. We are not responsible for:

The availability, accuracy, or reliability of third-party services
Any changes to third-party terms, pricing, or availability
Any content provided by third-party services
Any damages arising from your use of third-party services

Your use of third-party services is subject to their respective terms of service and privacy policies.

11. Intellectual Property

The CoverImage.app name, logo, and website design are our intellectual property. You may not use our branding without permission. Images accessed through our Service belong to their respective owners and are subject to their license terms.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination:

Your right to use the Service immediately ceases
We may delete your account and associated data
Sections 7-9 (Disclaimers, Limitations, Indemnification) survive termination

13. Governing Law & Disputes

These Terms are governed by the laws of the jurisdiction in which CoverImage.app operates, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration or in the courts of that jurisdiction. You waive any right to participate in class action lawsuits.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CoverImage.app regarding the Service and supersede all prior agreements and understandings.
